JUDGE ISSUES PRELIMINARY INJUNCTION AGAINST THE SWRCB
Hanford, Calif. — On September 12th, Kings County Superior Judge Ciuffini issued a preliminary injunction to KCFB against the California State Water Resources Control Board (SWRCB). This ruling means that all Tulare Lake Subbasin probationary requirements remain paused until the case goes to trial. A trial date has not been set at this time. “Being granted the preliminary injunction is a monumental win for Kings County Farm Bureau
and California agriculture. Receiving today’s ruling highlights the validity of our claims and showcases our likelihood to win in court in the future” said Dusty Ference, Executive Director of Kings County Farm Bureau.
In today’s court proceedings Judge Ciuffini ruled on the four demurrers submitted by the SWRCB. Sustaining 3 and overruling one. “Having Judge Ciuffini sustain our three demurrers justifies our challenge of the decision to be put on probation and we think speaks highly for our chances of further success when the case goes to trial,” said Ference. After Judge Ciuffini ruled on the demurrers, the court transitioned into a case management conference. KCFB will be back in court in January 2025 for a second case management conference.
